TRAFFIC LIGHT EAST ENTRANCE



Yes! Finally! Bookending this picture you can see poles upon which we believe we will eventually see our own dedicated traffic light. To the right of the exit (not pictured) you will see a pad which I believe will be for the control box. Of course there's a lot of bulldozing to be done before the north lanes are completed.

Speaking of exits, there's a protocol at the east exit which only some "get" and that's the first car there, waiting for a pause in the traffic to exit, should not be blocked by the second car, even if it's turning the opposite direction. Too often, an SUV will pull up alongside cutting off your view of traffic. Please?

I never understood why Discovery took down the sign at the east entrance. Being 'unlisted' is perhaps more exclusive, but how are you going to get people to know where it IS? Also, the SPANISH OAKS CLUB BOULEVARD street sign gave it/us away. For my money, Discovery should spell their name Duh-scovery.

But these are brighter days, indeed, as we are once again in the Daniel Porter years.

MUCH TRAFFIC AT OPEN HOUSES

The first of monthly open houses under renewed Daniel Porter management appeared to be quite a success as we saw more traffic at our end of the neighborhood than EVER. There was a nice display ad in the paper, too, perhaps the reason for the activity.

Telling: we know several of those with homes for sale are simply selling to build elsewhere within Spanish Oaks.

Having visitors enter from the west entrance was a good call for a better impression, given the road construction at the east side.

As for Highway 71, work progresses on the north side of the bridge and lanes and the projected August completion seems impossible, but then we don't drive earth movers!

OWNER MEETING 5 24 11

It was a decidedly sunny mood within this gathered group, notably different from other annual stormy meetings we've had in years past under another set of developers.

The new board of directors of the HOA was introduced: President Jack Krevling, VP Robbie Kidd, Secretary/Treasurer Diego Rubio. There is no homeowner rep on this board as of yet, but one is expected in the future. Pam Chandler stays on as HOA manager.

Original developer and SO visionary Daniel Porter was in attendance but did not speak.

Upon taking over the project, the new Declarant set to paying down the nearly $225,000 shortfall/debt left behind. They have also and obviously taken on the project of bringing the development back to much higher standards than we've seen in the past few years. Roads and landscaping are the first issues to be tackled, and they are about to replace damaged or dead landscaping. Trail repair is now a monthly item on the new operating plan.

The guards will be monitored for compliance to our standards. Starting soon we will return to a roving guard in daytime hours.

A study is underway to see how we could recycle water for irrigation in all common areas. There would be no watering restrictions on recycled non-potable water usage.

Lighting has fallen into some state of disrepair and is being fixed, replaced, or adjusted.

Design guidelines have been changed minimally (said to streamline and make more easily understood.) Cement roof tiles will be allowed. Copper gutters no longer required.

We are on track to have a fully functioning stop light at the east entrance.

A discussion of vandalism at the fishing camp and lodge may lead to removal of keycode access to the development. "Monitoring" of these areas is likely.

Signage will be placed to identify our community, and other development signage is in process of being restored, maintained, or replaced.

After the HOA meeting, Jack took questions regarding the Golf club, which is scheduled to reopen this Friday. There will be three types of membership: Local $40k; "National" (for those who live elsewhere, for example, Houston). I didn't get a price on that; and Social, at $12k and $260/mo.

REALTORS WELCOME

There was a 'do' for Realtors today to reintroduce Spanish Oaks under new owners. Here are the highlights, as reported:

Golf club opens late May. Old members will be grandfathered in. New members - need not be owners - $40,000. Social membership and Junior membership to come (I have no details but welcome any input.)

Developer lots reduced.

Owner meeting in early June. Looks like June 2 is a bad date as it is Lake Travis' Graduation.

Meanwhile the backside of Spanish Oaks Club Blvd is reported to be in reconstruction for repair.

Paving appears complete now (unless there's another 'coat',) from the east entrance up the hills both east and west. (The north side of the road will be lowered next.) The entrance driveway is temporarily both entrance and exit while a turn lane is being built into the exit drive.

FIRE



This was Sunday the 17th, facing East. The fire seems to have been beyond the road on the next ridge. This was not on Spanish Oaks property and appeared to have quite a way to go to reach us.

It turns out the fire was some distance beyond the next ridge, in West Oak Hill where homes were destroyed and many more threatened.

Underground community propane systems are made of several homes in a neighborhood connected to the same propane tank. There are 73 in the state, with 48 in Travis County and about 40 of those in western Travis County.

ANNUAL MEETING IN MAY

Said to be a "Meet the new board."

Dogs will no doubt have their noses temporarily out of joint as fireplugs are scheduled to be re/painted as part of the new Declarant's clean up fix up campaign said to include other overdue items.

It will be interesting to see what affect the Highway 71 widening will have on the East Entrance. It appears we will lose some ground, which I believe we'd all willingly donate for a real traffic light (see below).

HIGHWAY 71 WORK



I believe the plan is for completion by August. Here are pictures taken from our east entrance for those who have property but haven't moved here yet.

I doubt you can tell from these, but the eastbound lanes have been lowered, to reduce the hill, and change sight lines. Once paved, they will lower the westbound lanes.

Once upon a time we were told that the reason we COULD NOT have a traffic light at our east entrance was the sight lines, that someone could come barreling east on 71, only to rear-end any backup at that light. Lowering the crest will take that issue off the table. Perhaps we WILL have an actual traffic light.

BLOG REBIRTH

I bet few will notice, so spread the word if you think someone might care. After a long period of dormancy, this blog will resume. What with spring, the return of Daniel Porter as controller of Spanish Oaks' fate, we see progress and obvious efforts to clean the development up and attend to the things which were neglected by Discovery, then the bank.

I invite you to send pictures, news, etc.

The header says what the purpose of the blog is - a very small community voice, to help us all know what's going on and share with each other.

So let me share a positive discovery: we hired a company to come refresh our teak outside furniture. The process involves powerwashing, several applications of cleaner and after sanding, oil. Two days of hard labor. The results look as new: www.theteakpro.com

NOT THE END, BUT GOODBYE

After 557 posts - scroll through and believe it or not, you'll find some positivity within the opinion pieces and clear disappointments - I have decided to stop posting.

This should bring great joy to those who feel that one man can somehow damage a multi-multi million dollar land developer, albeit one with extremely poor communication skills.

Why stop? I just don't have the energy to absorb the slings and arrows of the anonymous posters who attack my motives, blame me for the bad economy, can't sell their properties because allegedly someone read something I posted. Say what you will, at least I haven't hidden away like those behind cowardly anonymous responses.

But I won't take the blog down.

I invite YOU to post what you feel are the pluses or minuses - make it YOUR community organ. You can e mail your comments for posting, or respond to posts - which are less visible. All input is welcome, will be moderated, but not edited unless something is way out of line. I will no longer post anonymous input.

I couldn't make it to the annual meeting. That's why I haven't reported on it.

From what I heard, it wouldn't surprise me if Discovery walks away or sells, and I think that might be a good thing as their investment in the future appears to challenge them. Or maybe the whole refinance is a dance between the partners, each looking for a better lever on the others.

So, seriously, contribute stories, pictures, and your vision. As it seems the golf side will separate from the rest of the development, this isn't for that side of things.

OAK WILT INFO

Only You Can Prevent Oak Wilt

With spring just around the corner, so too is the threat of oak wilt: the deadly disease that has killed thousands of oaks in 72 counties in central and west Texas. The Texas Forest Service (TFS) reminds the citizens of Texas this is the prime season for starting new oak wilt infections.

New oak wilt infections are created when sap-feeding beetles carry oak wilt spores to
fresh cuts or wounds on oaks. Tree sap from fresh wounds can attract sap-feeding beetles that may be carrying these oak wilt spores. When these spores are introduced to the wound, a new oak wilt infection is created. To prevent this from occurring, TFS recommends to:

1) Avoid pruning or wounding oaks from February through June.
2) Immediately paint cuts or wounds on oaks, regardless of season.

Wounding includes but is not limited to: pruning, construction activities, animal damage, land clearing, lawnmower or string trimmer damage, and storm damage.

Oak wilt spores and increased beetle activity occur in spring; therefore avoid pruning or wounding oaks during this most vulnerable time. Fresh wounds produce sap which in turn attract sap-feeding beetles; therefore apply paint to pruning cuts or other wounds immediately to prevent spore-carrying beetles from visiting your oak. Any type of paint will accomplish this task. These recommendations apply only to oaks as only oaks are susceptible to oak wilt.

Other preventative measures include using caution when selecting and transporting oak
wilt killed firewood and destroying diseased red oaks that can potentially produce oak wilt spores.

The ONE LANE scheme in either direction seems temporarily on hold or delay. We have to get through that inconvenience to attain a safer roadway.

You can see the men out there trenching, which I assume to be for utilities.

How will they span the creek?

Will they have to trench the east entrance? I suspect so, and the markings on the street there would seem to indicate same. It wouldn't surprise me to find us cut down to one exit for a term.

2009 ANNUAL MEETING... MID MAY 2010!!!

May 12th to be exact. That's just silly. These guys couldn't possibly report to the owners at the end of the year?

And since then, apparently, there's a financial crisis affecting the developer/s. Hey guys, you know that risk/reward equation? Man-up.

PLUS property owners appear to be having a 'dues revolt' according to a letter from the HOA rep. He adds: "The future of the development and the Club is not certain at this time." < OH REALLY? > "However, we must understand that the HOA is not a function of the Club, is not a function of the Developer" "and is a function of we who own property in Spanish Oaks. To that end we all must continue to abide by the principles we agreed to when we made the decision to live in this neighborhood."

I suppose you could argue that in pursuit of more sales, the 'principles' (earth tones, turf areas, natural looks) were altered to move more property. We certainly never agreed to them.

More: "The HOA is not a part of the Developer, is not a part of the Club, and is for the benefit of the owners of property in Spanish Oaks." But but, the HOA is completely managed by the developer. We have zero say in what they do. And they appear to do little.

We can't get a clean mail area without repeated complaints. (As if the HOA rep and manager don't notice.) A concrete curb on SO blvd has been broken for at least a year. A very large rock was moved out of place on the SO Blvd circle and the gouge resulting has been ignored for at least a very long time.

I could go on but if you live here you know inattention to detail just may be sparking some of the 'dues revolt' which is now over 6 figures of debt.

A NEIGHBOR WRITES

I am a resident over by the east gate. I went to get my mail this morning after being on a business trip for the past several days. The mail area trash was overflowing to the point where it was making a mess of the whole area.

Also, I have been noticing for almost two months now a burnt out lightbulb in the east mail room. I know that is a little thing, but little things often tell us about big things. I view the trash as a big thing. Prospective owners will never buy in here with these issues. Not one home owner in this development would treat their own property this way.

It is such a disappointing situation and it also seems unnecessary. We need to do something about this and somehow empower the owners. We all take pride in our neighborhood.

(Comment) ... we hear that Pam will remove the trash can. We wonder why it takes so long for her to notice and act. For that matter, why does our on-site home owner HOA rep also not cause action to be taken?

LETTER FROM THE BOARD

Arrived today (April 1) but no April Fool's Day gag, sorry to say.

Basically, they are holding off on the annual (this would be a wrap up of 2009!) meeting until they have better news or a more complete scenario regarding the club, finances, and bank negotiations. By the time they present this year's budget, the first quarter has passed.

Remember, the HOA is run by the developer until a certain high percent of sellout is reached (if ever.) Know that you have little meaningful input.

Issues raised include...

Maintenance. Apparently abated through the winter, it is due to start up in days. (Why let the weeds take over common areas at a time when sales are struggling? Wouldn't that make SO compare less favorably to its competition?) Are the developers so cash-strapped that they could allow the landscaping to deteriorate to such an extent? Reserves are less than $6000.

Monthly fees and foreclosures: some aren't paying, certain foreclosure properties exacerbate budget shortfalls. Now there will be legal fees chasing lost or held money.
Why haven't money saving measures already been put into place wisely? Do we need guards on BOTH gates over night (as an example?)

The letter seems to paint a picture of responsible actions being taken. Time will tell, although new financing could present interesting terms. I get the impression that a new investor could bring a fresh infusion of operating funds which could kickstart the sales cycle again. But how would that change the vision of what SO is and will be?

FINALLY?

Spring Clean up starts Saturday and continues Monday and Tuesday. This includes chemical weed treatment.

QUESTIONS FOR ANNUAL MEETING

As Discovery is communication-challenged, we don't know the answers to the questions which revolve around the financial woes of the developer:

You might wish to expand on these topics and prepare now to attend the annual meeting (as of this writing, unscheduled) which is perhaps the most important one we've had in our short life as Spanish Oaks. The more people who speak up, stand up and make their feelings known, the more force it will have. This is no time to be passive-aggressive.

It is said that the annual (2009!) meeting is being held off until they get their financial house in better order.

1- Are funds co-mingled from the golf club to the general project?

2- Why is there only about $5000 in the reserve fund for the project? (Note east side road deterioration.)

3- What is being done about the sorry state of our common areas: weeds, erosion to the 'paths,' the broken curbing, the mail area trash? What is the state of our common area landscaping contract?

4- How does the east end mail area get so trashy AND NO ONE IN MANAGEMENT notices until upset owners complain? How can we insure more pro activity?

5- Is it time to seriously talk about eliminating staffing both gates - at least overnight - to reduce expenses? (Speed passes and push button codes would allow entry.)

6- What plan does Discovery have to revitalize the project?

For new owners note: When Daniel Porter passed control to Discovery, we noted a different view of the 'plan' for the community and what appeared to be a relaxed set of design rules. IF THAT HAPPENS AGAIN, we can expect another set of changes. Will this affect us and how?

LAND SNAKES ALIVE!


Here's the first little one I've seen this spring - apparently run over, squashed and drying... but you have to remember they hatch in batches and where's there's baby there's mama. This one looks benign, but there are others with nasty fangs to be avoided. A hint - watch out if you plan to take pictures of babies laying in bluebonnets. Remind the kids... snakes are part of life here. Be careful. Look before you thrust your hand into somewhere you can't see.

As cold blooded, they will seek warmth from garages, rocks, and maybe even porches in the evenings and nights.

Also know that baby rattlers have no rattle but do have a full dose of venom.

Like some politicians.

PROPANE... PROPAIN?

I had a call from a rep for Sharp Energy who reads this blog - hello Kim!

She gave me some background on the installation of the new larger propane tank in Spanish Oaks. Things to know: it will exist in a 100 year flood plain which complicates the issue in that measures must be taken to keep it in place in the unlikely event... (it will sit above ground but will be shielded from view.)

It's anticipated to be installed this summer.

Our costs will not be appreciably affected by the larger tank - i.e.: fewer deliveries.

Owners of Spanish Oaks, a 911-acre luxury residential and golf course development in Bee Cave, are in talks with their lenders to revise the terms of a $32 million loan and avert foreclosure.

Daniel Porter, Spanish Oaks' original developer, said that the problem arose when a recent appraisal valued the project at less than the amount required under the terms of the loan from Comerica Bank.

Porter said he couldn't disclose the appraisal amount.

Spanish Oaks, south of Texas 71 and Bee Cave Road, is among the high-end residential projects in Central Texas to run into financial headwinds from the economic downturn. Several others ended up in foreclosure, but Porter said Comerica has indicated its willingness to work with the owners to forestall that outcome.

Under the original vision, the project was to have been completed by 2012 with 436 homes — an estimated $600 million worth of real estate, Porter said.

To date, 270 lots have been sold and 125 homes have been built, with an average price of $1.5 million. Golf Digest has ranked Spanish Oaks Country Club as one of the top private golf courses in the country.

The project is owned by Spanish Oaks LP, a partnership consisting of Ross Perot Jr.'s Hillwood Development Co. LLC, which owns 65 percent; Discovery Land Co. LLC, with 15 percent; and Porter's CCNG Realty Inc., with 20 percent.

Hillwood and Discovery, the project's managing partner, were brought in as investors in 2005, pumping in $20 million along with CCNG, Porter said.

Sales began in April 2002, with the first 25 lots selling that year at an average price of $130,000, Porter said.

In 2004, CCNG sold 65 lots at an average of $160,000. Lot prices peaked in 2008 when they averaged $500,000.

But just 12 lots were sold in 2008, and only six were sold last year, averaging $424,000, Porter said.

"It was like a rock falling out of the sky," Porter said of the sales.

"A lot of people are wanting to do something to try to keep this project from falling into a bad way financially, " Porter said. "It's too good a project."

The loan negotiations involve the golf course, unsold lots and undeveloped land. Porter said the partners have invested $70 million, including the golf course, roads and utilities.

For now, the golf course remains open to members and their guests, although the clubhouse has reduced hours and laid off some employees.

Porter said CCNG has made an offer to the partnership to buy the golf course. A letter of intent was signed, but no binding agreement was reached.

"It's a great project and a great golf course, " Porter said. "The members love it. We just have to work through this."

Discovery oversees Spanish Oaks' golf club, development and sales operations.

In a statement Friday, Michael Meldman, chairman and CEO of Discovery, said the company is working with "the membership and our majority partners to address long-term plans" for the club's operation.

Todd Platt, CEO of Hillwood Investments, said the partners are hoping to find a way to transfer the course to its members.

An attorney for Comerica did not return messages seeking comment.

David Armbrust, Porter's attorney, said that Spanish Oaks has suffered from the slowing economy.

"I think Spanish Oaks is kind of a poster child for the effect the economy has had on western Travis County from the standpoint of a drop in property values that has affected raw land, developed land and individual homes," Armbrust said. "The problem is, there are no transactions, really."

Appraisers can use such market activity to set property values.

Other area projects also have been hit by the lingering economic slump.

Last year, the 468-acre Rocky Creek Ranch off Hamilton Pool Road, where 396 upscale homes were envisioned, became one of the region's biggest residential foreclosures. CB Richard Ellis began marketing the property in November for $17.5 million.

Other foreclosure actions included Vizcaya, a luxury residential development planned on the south shore of Lake Travis; MDR Hollows LP, developer of the Hollows resort on the north shore of Lake Travis; and Avaña, a proposed 1,000-acre residential development at Texas 45 and Escarpment Boulevard.

Spanish Oaks originally encompassed 1,211 acres, but 120 acres were sold to Cypress Realty Inc., which later sold 88 of those to developers of the nearby Shops at the Galleria.

CCNG owns another 77 acres at Spanish Oaks that allow for mixed-use commercial development, Porter said.

Armbrust thinks the region is at the tail end of the major foreclosures and "things are looking up," with more buyers kicking the tires for deals.

Despite its financial distress, Armbrust said Spanish Oaks is "a great project," and "with an improving economy, the future is bright."

"They need some consideration from the bank at this point to get from here to there," Armbrust said.

DANIEL PORTER TAKES OVER SALES OFFICES

It seems Spanish Oaks founder Daniel Porter has resumed operations in what has been the Spanish Oaks Sales Offices. There's a new sign which lists two 'groups.'. The question I have is Spanish Oaks Realty one of HIS entities or the Discovery crew.

MESSAGE FROM SOGC BOARD OF DIRECTORS March 2, 2010

On behalf of the SOGC, Inc Board of Directors, thank you for this opportunity to provide current information on the affairs of Spanish Oaks Golf Club.

We last wrote on February 5, 2010 to inform you negotiations were underway to restructure Spanish Oaks’ loan with Comerica Bank and obtain a release of collateral secured by Club assets. Since that time, Spanish Oaks, LP (the ownership group) held conversations with the Board of Governors and continued negotiations with Comerica.

Regretfully, ongoing discussions with the Bank have yet to be resolved.

The limited funds available to operate the Club require a suspension of all services with the exception of golf operations. The course and practice facility will remain open. In addition, a limited lunch menu will be served from 11:00am – 2:00pm. We apologize for any inconvenience this may cause you and your family and commit to notify you promptly of any further changes.

SPANISH OAKS GOLF CLUB CLOSING?

Rumors have been flying. Four separate sources over several days have come forward. HOA manager Pam Chandler either doesn't know or isn't allowed to speak. Yes, she works 'for the HOA' but that's controlled by the developer.

Here's what I believe is happening. For some reason as yet unknown, Discovery Land Company is apparently abandoning management of the Golf Club. Supposedly there's a members' meeting tomorrow at which they will attempt to put together a plan to operate it themselves.

You have to assume Discovery, if they really throw in the towel on golf, must admit their business plan, in this economy at this time, has failed.

The larger story may be how Discovery then continues selling this development as a Golf Club (which they have closed?) It's a bad mark, is poorly handled, and they certainly don't know how to handle rumor control.

And... what's next?

ROAD SINKS

You just took delivery of that Bentley. It's almost spring. It's a perfect sunset, the temperature about 65. You are on the backside of Spanish Oaks Club Boulevard. It looks wide open. No traffic. No kids. The devil on your right shoulder snarls, "To the FLOOR!" You obey. Within seconds your nerves all fire at once as you approach triple digit speed. Then, "WHAM!!!" your suspension takes a hit.

Later, Donny, the Bentley repair guy, puts the cost at $5000 and change. He says, "These babies are really built tight, or it could have cost some REAL money!"

This fantasy brought to you by the road sinking patch on the rear of Spanish Oaks Boulevard. Last we saw it was marked with cones.

SNOW

Transplants know that everyone in the media - well, TV anyway, WAYoverreacted. An inch. --- LIVE TEAM COVERAGE --- Ooooooo.

But in a strange logic, why not? After all, this is the second time IN 19 YEARS since we had all that much snow at once. One inch.

Now it's a day later, the temperature in the shade is 50+ and there are still a few snowpatch refugees, hiding in mulch, defying their genetic programming to wet themselves.

THE BIG PROPANE TANK

According to the MUD engineer, we are very near to installation of the tank. After many iterations of the site plan, they have finally received approvals from TCEQ & The City of Bee Cave.

This will be much larger than what we have, which requires more fillups which also add fees each time.

TURKEYS!!!


I just happened to turn around and look out the window - something I do many many times daily, but this time the whole slope was covered!!! By a flock of wild turkeys! Grabbing for my camera I didn't have time to count as I had to defeat the focus which was trying to focus on our window screens, not the birds... there had to be two DOZEN and they weren't little ones, either. They milled about then slowly headed down to the area of Overlook Pass.

The hills ARE alive, and not with the sound of music!

THE OLD GOOD OLD DAYS?

We arrived by buckboard wagon all those years ago (January, 2005.) We were among the earliest settlers here in Spanish Oaks. I thought it might be interesting to list some of the early day memories for those who look back. While at it, let's give Daniel Porter thanks as we sit down to TurDuckEn, for his initial vision of what this special place could be.

You might remember:

Ray Ware - the salesman who enthused so believably (and who semi-promised a traffic light in a year.)

Last night at the Lodge, newbies mixed with old settlers as Spanish Oaks Fall Happy Hour brought a couple dozen residents together at the Lodge for several hours of meet'n'greets. In great contrast to the contentious 'annual' meeting, this low key affair really was a pleasant evening.

GETTING AGGRESSIVE?

Spanish Oaks, for years said to be somewhat 'reserved' in its approach to sales, has apparently turned up the heat.

First there was the LIVESTRONG two-home tour, bringing what looked to be thousands of viewers into the development.

Now there's an auction this weekend, open to the public 'worth the drive'. Not of a house, but of items brought in for the auction - it's not all that uncommon, but it might be a first here.

Also in the Sunday paper what appears to be a group-broker promotion - 5 homes linked in a "Progressive Open House Party."

WHY HAS THIS BLOG SLOWED DOWN?

An accident has kept me from blogging lately, and likely will slow down what I have been doing, at least for the next month or so, although today is the second day back at the computer in over two weeks.

I was cutting the grass when I tripped over a rock while walking backwards - you know - you go forwards then backwards over some areas. As I went down on my back, the only thing I was holding was the handle of the lawn mower and I must have pulled it toward me. Over my foot.

I came very close to cutting off my toes.

So, long story short: 3 hour surgery, hospital, now home and long recovery. Maybe not long in the scheme of things, but at least another month to go. I am lucky that the surgeon saved my toes. They are still attached.

It's a day by day thing - believe me, getting back to the computer is a VERY big deal. I am going to blog the whole recovery period at once, when it's over, and am keeping myself busy with writing daily thoughts. Until yesterday, all via Blackberry. The notes give me the ability to get my mind off the long road ahead. As I heal I will gain energy and return to writing other things as they come into my life and thoughts. This is unscientific but absolutely real. I put an empty bucket out where our pool equipment lives. It was empty. We had two storms. I haven't touched it and the roof empties onto a gutter so that's not it. Hope you can see it's almost full!

OIL, STRIPES, ROADWORK

In reply to the road cleanup issues several posts below, Pam Chandler writes, "I've received several calls concerning an oil spill on the Boulevard, running from the east entrance all the way back to Krause Lane. We do know the guilty party, and they will be cleaning up the spill, as well as moving the large boulder at the roundabout that the same truck moved."

Also, re the striping: "On Monday, 9/21, our paving contractor will be on-site to do striping work. They will be re-striping at the east entrance near Hwy. 71, will be painting a double yellow stripe on the bridge at the east entry, and will be re-striping the double yellow stripe on the west side bridge. Please watch out for workers and traffic control cones when coming and going on Monday. In the event we are "rained out", the work will be done on Tuesday, 9/22"

This will, we hope, keep people more alert about where on the bridge and entry they actually ARE, as in, in your lane coming toward you!

And about Highway 71: "The project is now slated to start sometime in January. The work will begin with the widening of the road and bridge, and we should anticipate that only one lane in each direction on Hwy. 71 will be open during this project."

MEETING WITH OWNER HOA REP



"What we have here, is a lack of communication..."

Tonight was a step in the right direction, though it seems clear all our concerns will not be addressed or addressed in a manner we find satisfactory. But that's okay.

We can assume we all chose S.O. over competing developments because we like it here and want to be a part of it.

Here's the deal - the bottom line - if the rep, Pam, the board, whomever, would apprise us on a regular and ongoing basis of the items and issues being addressed, we'd all feel more pride in the ownership and a greater sense of belonging.

Maybe they don't do that because they fear inundation by other points of view or agendas. I understand that fear, but also feel it comes with the territory. We all are united in wanting this development to live up to its potential.

REMEDIATION... EFFORT?

There are some locals who believe the development is going downhill. Here's recent evidence. To be blunt, this would have to be put to the issues of:

Communication
It flat out stinks, and our HOA "rep" had to be goaded into holding a meeting (next week) with anyone who still cares, as he's the opposite of communicative or proactive. His term is without limits?

The board communicates as if in their ivory tower. You have to ask yourself if they even visit? Our HOA manager, Pam Chandler, is likely hamstrung by their inaction or by gag order. TIMELY responses and fixes are woefully lacking. Priorities can't be those of everyone with an 'issue' but better - much better - communication would pull us all together and feel that there are wise and concerned hands on the helm.

Striping the east entrance road as a safety measure was promised asap back at the annual meeting... just an example.

Resources
What resources exist are a mystery. We apparently have no maintenance. Drought and water conservation have seemingly infused our buffalo grass common areas with many weeds.

CC&Rs
We have at lease several WHITE houses (an EARTH TONE?) - more sweeps of non-natural turfgrass, and now - we hope! temporary - an asphalt driveway.

Management

Write any definition of management you wish - perhaps behind the scenes it's a well-oiled machine, but to the owners who have invested, it's not at all obvious that proper attention is being paid.

And here's a sobering thought/question: how many of Discovery properties around the US have had their HOAs turned to the owners? As it stands now, I can't imagine how far off in the future THAT will happen here, if ever. Which means the status quo is one we seem to face for a long, long time.

One example (this is a followup to the post one post below):


Some truck leaked what looks like oil or tar over our roadway (SO BLVD) and drove over the sidewalk pavers. The stream goes as far at Highway 71. Workers were attempting to clean it Friday. Has someone tried to trace this back to the source to make them clean it up? Or was this their effort?


Here's a picture of the missing rock referenced in the post below. It was dragged away by a truck, and never replaced. This is a very visible spot in a multi-multi million dollar development.


Now, as recently as Friday, another rock has been dragged. If the first rock (apparently ineffectual, by the way, as it was there to prevent trucks from riding up over the circle) wasn't ever replaced with another rock to hide the gouge, then what can we expect here? It's now proven they don't work. Can we expect a cleanup/solution? When?


Here's the 'cleaned' area on the 'sidewalk' of the circle - the street doesn't appear to be touched. Is that IT? (Ref: bad communication; resources; management.)

OIL? TAR?

Don't know what it is - some truck managed to leave a pretty good stream of black liquid onto the east side traffic circle and then down the road to Highway 71. They even drove over the pavers at the circle.

In an unusually quick response (days, instead of weeks or months or longer - as in the promised east entrance striping) Discovery apparently has a crew trying to get it up - at least on the pavers. I stopped and chatted with the guy who seemed to be in charge. "We're trying acetone," he said... "do you have any idea what would work?" I suggested a pressure washer.

You can see that the offending truck tried to beat the radius of the turn and that's when it drove over the pavers. Once upon a time we were told that circle would be redone to accommodate larger trucks which find the radius too tight. And that was... years ago?

Looking at the circle, they have never replaced the boulder that was dragged away under another truck (leaving a gouge) what seems like a long time ago. It was one of three, in place to try to stop trucks from going up on the pavers. A grass patch would at least spiff that up.

You have to wonder if, for the LIVESTRONG open houses this fall, perhaps some work will finally be attended to? Yes, the economy has faltered, and that must surely have affected projections for sales at S.O. - but at some point the weeds and other things which need attention accelerate the spiral down, and cost more in the long run.

71 WRECK

A lot owner reports flaming car, lifeflight, etc. at east entrance? No other details at 12:45PM Saturday. From our location, can see traffic backed up westbound.

We saw the highway - the accident appears to have been not exactly at the east entrance, but farther down toward the bridge over Barton Creek - the bridge on 71, not within our entrance. Update: 9 PEOPLE INJURED. Apparently someone was turning, was rear-ended, and that vehicle was then rear-ended.

ARMADILLO MADNESS



Another 'dillo trapped!

That's now 1 raccoon, 1 cat, 3 armadillos!

There must be some armadillo graffiti at the armadillo bar - "For a Good Time, dine at Wood's! Dine under the shrubs!" It's a %$#@ PARADE of 'dillos, it seems.

Another ride up Highway 71 with a stinker in the trap in the trunk - about 10 miles... and release. This one was slow to escape the cage and immediately went under the car and a tire. HEY!

I am NOT going to accept suicide after schlepping this varmint this far.

And so, I edged away, and the beast was seen waddling away up a hill.

TRAPPING VARMINTS


After two Armadillos and one Racoon, we'd hope for no more shrub-digging-lawn-ripping. But it isn't to be. I reset the trap and put it in the usual place.

This morning Terri came back from walking the dog with a smile and a "Guess what the Catch Du Jour is?"

Feral or not, my intention is not to catch cats. I am allergic to cats and would be happy to see them all only at a distance.

Kitty was plenty ticked. Can't say I blame it. Released now (like a shot out of a cannon - swear I heard "Thufferin' Thuccotash!" as it ran) with no scratches of vengeance for Trapper Bob.

Here's this cat, apparently successfully avoiding all sorts of predators, only to sniff a can of CATFOOD in that cage thing... (Well, heck, somebody told me to bait the trap with that. It worked before!)

No harm no foul.

It does suggest that one shouldn't set traps and then not pay attention - or go on vacation, because you can't always get what you want, etc.

I am greatly relieved I didn't have to worry about a large snake which might have crawled into the trap.

BATS UNDER EAST ENTRANCE BRIDGE

Richard Finlayson writes: Bob, have you seen the bats under the bridge over Little Barton Creek at the (east) entrance? It’s just like Congress Street Bridge. We were there Monday night at 8:03 and it was a fire hose of bats taking off into the sky.

Note 2: If you go to watch the bats ALSO watch out for traffic which as we all know, can come down toward the bridge at high speed and in the center of the (still unstriped!) road.

LIGHTNING STRIKE STORY


Bob, here’s a photo of the damage. The fire was caused when the charge arced from copper plumbing and/or electrical to the gas line. Not sure which way that charge arced, but it blew a pin hole in the gas line and ignited. The flame ignited the framing. You can see the charred gas line and the burned romex. There’s a copper line running through it that looks to me like an arc point but it’s hard to tell.

My family saved the day! Kristin got shocked as she stood by a sink and knew there was trouble. They kept looking around and started to smell smoke. The boys pulled the attic access and found nothing. My 9 year old remembered another access by her room and whey they pulled that access they could see the fire. My son John grabbed fire extinguishers one after the other and he and Will put out the fire. It wasn’t known that the gas line was involved, it makes my heart stop to think about my boys up there putting that fire out with a gas line leak. We are very blessed that everyone is safe, that my kids knew what to do and did it, and that we didn’t lose the house. Lessons learned? Have fire extinguishers, lots of them. The boys think they used two, but there were three empty canisters up there. Also, store photos and videos in waterproof containers and by the front door. (Not the garage door. Garages are the #1 source of home fires.) I knew where all the family videos were but couldn’t relate that to my son, and when the attic access ladder was pulled down it blocked the closet doors that all the family photos are in. It was also directly under the fire and would have been ruined by water if the fire department had been required to put it out. We have already started the “what if” scenarios to be better prepared next time for things like this. The fire department was great, but it is concerning that they had a hard time finding us. The neighbors report seeing them wandering around at the Overlook Pass and Paraiso Pkwy intersection. They ended up down in the culdesac on Warbler Ledge even though there are large numbers on all the mailboxes. I’m going to call and see what we could do to help them zero in faster next time. We are pretty much put back together and the plumbing, electrical, and losses have been manageable. It is interesting that the DC transformers on items that were plugged in got zapped. Electronics, notebooks, AC unit, garage door openers, etc. All direct AC electronics were fine, but the transformers got nuked.

LIGHTNING STRIKE

Wednesday's rain showers brought with them a little drama. A lightning strike hit a house right across the street from Spanish Oaks, on Overlook Pass just beyond the gate into The Preserve. No other details are available at this time. If I get more, I will repost.

We have friends deeper into the Preserve, and in the past, they have had costly lightning-related electrical issues TWICE. Since both houses mentioned sit below ours, we only wonder...

Bee Cave Planning and Zoning Commission Chair Terri Wood reports that in a conversation with TxDot today, she was told that the project for highway widening to impact our east entrance has been pushed back, but only a little. Bids will be taken in the fall with work projected to begin in April.

HIGHWAY 71 PLANS ON HOLD?

I can't find anything by doing a quick search on Google, but a good source informs me that the Highway 71 plans for a center turn lane, etc., have been put on hold. Work was to have begun this summer. Since this has been such a big issue, I will continue to investigate.

Click here to see the latest info I could find. This doesn't seem to gibe with 'on hold.' Will find out more.

Meanwhile, other questions INSIDE the gates:

1- Why hasn't the east entrance center striping happened yet? Wasn't it promised asap at the 'annual' meeting?

2- When will the broken curb on SO Blvd be repaired?

3- Why are there so many weeds all over the grassed areas along SO Blvd?

4- A seemingly long time ago, a truck dragged one of the three large rocks away from the roundabout on SO Blvd (east side) - it was never replaced and there's been a gouge there - where it used to be - ever since. Ironically the rocks were placed there to prevent large trucks from running over that very area.

We were also told (again, seemingly long ago) that the roundabout would be rebuilt with a more effective radius. If so, when? If not, why not?

5- Why no regular ongoing communication from our HOA rep?

By the way, I've been told and have seen that crushed granite driveways can be approved here.

'DILLO NUMBER DEUX

The other night while taking the dog out for her before-bedtime necessaries, I spotted another armadillo browsing our shrubbery beds. I noted another large hole dug around our gas pipe feed, just like there was when the LAST armadillo was trapped. Though we had filled it in, these guys are super diggers, and the hole had reappeared.

I take Jessie out with a flashlight, always on the lookout for snakes, said to be especially restless during this heat. So I shine it around and that's when I saw the beast.

I set the trap and today Terri greeted me (she walks Jessie in the early morning) with a "You're going for a ride today!" We caught the bugger and I am charged with driving it away, hopefully far enough that it would not come back. (My limit is 10 miles.)

After the photo shoot, we headed to a side road off Rt 71 (busy highway) to just outside a new development deeper into the Hill Country called Bee Creek. I released on the rocky, undeveloped side of the road but the 'Dillo took off at a run across the road and into the lush greenery of the new tract. I thought I could see a smile.
