ANNUAL MEETING

Last night the 2008 annual meeting was held at the Lodge. It was attended by about 60 people. Refreshments and pizza were served as owners arrived and mingled.

When the meeting began, Pam Chandler said she'd cover all the questions which had been submitted and from the floor and would also summarize in writing to all within a few days. There were many recurring items, and I'll try to cover some of the more universal ones and general news, but will save the detail for Pam's letter.

General Information: I believe I got this right. I attempted to record the meeting but my recorder died early on.

Sales for the past year were lower than projections. Discovery is working on some undisclosed realtor incentives. (Comment: if they'd accelerate/invest in fixing some of the roads and other issues they'd probably enhance the saleability of lots and homes within. Sunken roads around manholes, ref: SO Blvd roundabout, broken curb, etc., pull our overall aesthetic down when compared to other developments of multi-million dollar homes.) Discovery has done away with maintenance personnel - Pam is 'borrowing' from Daniel Porter's people. Draw your own conclusion.

Discovery has installed or completed a system which would allow one gate guard to control the other gate. It's unclear what advantage this has in practicality, but they are also monitoring the traffic flow overnight to see if one guard is all that is necessary. They attempted to bring all "security" in house but that failed. There was no indication they'd try again.

Great confusion over highway 71 plans: there is said to be a plan afoot to lower the crest of a hill, but whether or not it's the east or west gate side remains to be clarified. I took this to mean the west side, and in 2010 there would be a light at the west entrance. Later that became unclear. Perhaps Pam will clarify.

There will be no light at the east entrance in the foreseeable future. As for a turn lane (westbound at east entrance,) I think the issue is they'd have to widen the bridge to allow enough space for a turn lane after the bridge. IMHO - don't hold your breath. Noted: the way the crews mangled and dumped the trees when they 'trimmed' the trees away from power lines across 71. The concrete 'turtles" in mid 71 are TXdot issues and obviously not high at all on their list, if even ON their list.

There seemed to be a consensus that our HOA website needs to be redone and a volunteer has been identified, though unnamed, nor was there a timetable given for this or for solutions to apply to many of the issues raised, for instance, the striping of lanes at east entrance at the bridge, or road fixes.

A discussion was held about speeding through the development. This led to the issue of those who walk in the dark in dark clothing, and on the streets. I note that there are no paths on lower Musket Rim or lower Paraiso or Overlook Pass.

The developer has finished landscaping, i.e.: no more new materials to be added to the project. Their hope is that with careful water conservation and time, what exists can grow in and fill out what might look sparse.

The pool will open possibly before memorial Day but as Pam is officed there will open it for you upon request. The Lodge is available free for owners who wish to host special parties, etc. See Pam.

Signups were offered for committees and social groups.

There is an ongoing issue of design compliance and builder failures/defaults.

LAWN CARE QUESTION

I have been trying to get TruGreen to come by and discuss what I want done. After a few years of trying organics, then moving to over-the-counter chemicals, we are still loaded with weeds. I thought maybe going with professionals would help.

The line of the decade, uttered by the TruGreen rep on the phone, "We don't feel we have to earn your trust."

I found this
which is a series of serious complaints from all over the country. Maybe their customer base is so large that these are isolated instances, or not... there seems to be a thread running through it, which also is implicit in the arrogance of the rep with whom I spoke.

So please, let me ask you this - I've seen the truck locally - if you use TruGreen/Chemlawn, are you receiving good service and effective treatments? If not, or if otherwise, who would you recommend? E me at rwood24@Austin.rr.com Thanks.

ANOTHER SURE SIGN OF SPRING?

A SURE SIGN OF SPRING!

Up north they'd say the robin has that honor. Here it's the first SNAKE SIGHTING. And it's just been reported from just over the border of the S.O.-landlocked Preserve, which is at the gate at the end of Overlook Pass (for those westenders.)

There are good ones and bad ones they tell me. As far as I am concerned, I don't even trust HOSES. I CAN promise you that when you spot your snake, it'll blend in really well - amazingly well, unless you are driving forward and backward over it on the road. If you do this, just rest assured that cleanup is crow and vulture job 1.

So tell your kiddies, give your dog a talking to, and watch those thresholds where the slithery reptile will stretch out and pretend like it belongs there. Look before you reach into something, and stay alert.

The same precautions apply to members of congress.

ANNUAL MEETING MISPERCEPTION

I apologize.

I was just told by Pam Chandler that the HOA board can choose to hold their/our annual meeting any time they wish - not forced to do so by the end of the closing year. The confusion on that issue, she told me, was that the FIRST meeting was to be held within the first year - after that - on the HOA's own timetable. My frustrations in posts below were obviously a waste of gas.

Terri and I love Spanish Oaks. We searched the country for several years to find the best city and then within the city, the ideal spot to anchor as our last move. Until now, our moves had been work-dictates. My time in radio took me all over North America. I used to joke that we were sharecroppers, working the antenna farms.

When you consider that we don't play golf, and don't have children, this speaks even more strongly to our belief in Spanish Oaks as a great place, even without the golf and club amenities, even without the wonderful school system in which we are placed!

What brought us to Austin was the exceptional mix of people and the incredible town vibe. What brought us to Spanish Oaks was Daniel Porter's vision of a natural beauty. Mark Moulkers designed and built us the home which fit us so well.

I came to feel that what we needed was better communication, especially so after Discovery Land entered the picture. I was a one-man communications committee until I could no longer receive answers in a timely manner. Along the way, this blog was conceived to sort of serve as a very abbreviated town 'newspaper' though there's all too often no news to share, and only a rare 'reporter.' News and opinion - that's the idea. Last time I looked there were in the neighborhood of 40,000 hits to date.

By now you've received your official notice of the annual meeting and attached to it, a letter from Donald Abrams, our HOA rep for several years now. This is exactly the kind of communication which I feel - on a more regular basis - would help pull us together from the odds and ends of our busy lives to help create a growing sense of community.

In some ways, the large geography of the project isolates us all into our cul-de-sacs and interests. Better communication can help us all become more familiar with one another and turn us into even more highly satisfied residents who volunteer the best possible testimony for living here.

There's room to grow.

Have we reached critical mass?

Reading Donald's letter you'd have to admit that a lot has happened in a year - perhaps most notably the opening and operation of the Lodge - a great amenity.

Challenges for the future will include maintenance of our infrastructure, and then - this one is big - a satisfactory hand off from Discovery to our own self-contained independent HOA (reached at some high percentage of build-out/sales.) I write 'satisfactory' because we need assurance that, at the hand-over, many items are covered completely so that we don't inherit issues beyond those unforeseen.

And so once again I apologize for the windbagian call to arms regarding the late annual meeting. I also invite you to become a part of this blog. The Association will hold its Annual Meeting on Thursday, March 26, 2009, at the Spanish Oaks Lodge – 6:30 p.m. We will have our business meeting, followed by refreshments and time for socializing with our neighbors. The Board and I look forward to our first meeting at the new facility.

An Annual Report will be presented, with opportunity for questions and discussion. In addition, the developer will update us on progress over the past year, and the plans for 2009. Please mark your calendars and make every effort to attend. This is a great time to ask questions, meet your neighbors, and stay informed about your community.

NEW GOOD RESTAURANT VERY LOCAL

It's the old Jim Bob's Trading Post, now a wine bar, at 71 and Bee Caves Road.

We ate there Tuesday evening - and loved it. The salad, main course and desert were all superb. I'm no restaurant critic, but I have eaten at some fine, fine restaurants, worldwide. Trust me. This is a find and couldn't be closer!

I didn't think they could convert from what was to what is, but it's not a conversion, it's a whole new thing - I suspect for an entirely new clientele. That's you.

I almost hate to write this because the place will become crowded. We loved it and wish the owners well!

ANNUAL MEETING - ?

Looks like we are on track to miss February too. Isn't there a rule where they have to hold these annually, not annually-and-a-couple-months-later? Hopefully there will be a more substantial explanation than, "Sorry, we couldn't get everyone together - but you know the holidays and all..."

ALMOST ANNUAL MEETING

This from a resident: I emailed Pam Chandler today to ask for info on the meeting. She said that it would be coming up in late February, and that she'll be sending out email and other communications.

Was that it - the notice in the quarterly bill? Didn't it say a more formal announcement would be forthcoming? Did you receive that? We haven't. IF the meeting is this week, wouldn't you think they'd give a little more formal notice so you could plan to attend?

PREPARE FOR ANNUAL MEETING

Having been to several annuals, as 'older' residents, we've been disappointed by the quick, off-hand or casual response to questions. This prompts some suggestions:

Make a list now. Bring it with you. Go through it on site, when given the floor, while you have access to the board. In the past, some answers were 'promised' with "let us get back to you on that" - and the answer died in privacy, assuming it was ever delivered. I ask you to share with this blog - in effect our only organ of wide communication - any of those answers you are promised, when they are received. Also please share if you don't receive answers.

Recently I met some neighbors who have been somewhat vocal in their detailed and thought-out concerns and suggestions yet haven't received answers. I have found such info spotty myself, and in fact, not forthcoming at all from our HOA rep, which is why I quit the more formal 'communications' post.

I'd like to see this community become more united, with more sharing of information and concerns back and forth from and to the board. We have no real power - no votes - but we can be the best salespeople for our community when armed with regular progress reports and good, honest looks at issues and solutions, with firm timetables.

Frankly, the way the HOA board is structured is as a dictatorship. We are stuck with that structure for now. But surely we can come together with a goal of better communication in the interest of mutual benefit - we, as happy representatives of our growing community, and Discovery as more effective stewards of our future.

WATER UPDATE

Interim repairs made to severed electrical line in West Travis County water system; irrigation system use should be curtailed for several days

For Immediate Release: January 12, 2009 10:40 PM

AUSTIN — Interim repairs were made Monday night to a severed electrical line providing power to the pumps at the West Travis County Regional Water System (in western Travis County and northern Hays County).

“We would like to thank our customers for their quick response and cooperation,” said Janet Stephenson, West Travis County Regional Manager.

Despite the restoration of power, LCRA asks customers to curtail use of irrigation systems until permanent repairs are made. That process could take several days.

The affected area includes residents in Bee Cave and other communities along Texas 71 and RR 620; and Dripping Springs, along with developments on US 290.

Around noon Monday, contractors working on an expansion of the system inadvertently cut an underground electrical cable that services the raw water intake pumps. That meant water could not be delivered to the water treatment plant, which is near the intersection of Texas 71 and Bee Caves Road. There were no injuries involved when the electrical cable was cut.

The severed line was spliced around 9:30 p.m. Monday and the pumps began filling the water storage tanks.

December 31 about 10AM - The end of the year brought a brief flurry of flames whipped by winds across highway 71 from the east entrance. Drivers quickly called 911 and the fire department responded to beat down the flames before they could move beyond the ditch into the scrub and cedars behind.

Despite prohibition on bottle rockets and the like, fireworks tonight could cause spot grass fires throughout Austin given our exceptional drought and low humidity.

A CHRISTMAS BEE CAVE MYSTERY... SOLVED

I thought what follows may be a hoax, but darn if it doesn't look real. Maybe YOU know and can add a comment. I'll give you the story but omit the contact since that might infringe on someone's privacy, except know that it came from 78738. I am unfamiliar with the road name, but they sprout up so quickly in this fast-growing area. Terri thinks it's on the west side.

'Twas almost the night before Christmas...

"Bob,

We have a wreath on our front door that has fresh fruit in it. Last night this animal crawled up the door and ate the apples. Any idea what it is since we are new to Texas. It looks like a lemur?

It was not aggressive we watched it for about 5 minutes and when it was finished it just walked away. The tail was at least 24 inches and he used it like a monkey would. He was about 18 inches tall when he walked away. I guess it weighed about 20 pounds.

What do you think it is?

TIME WARNER SWITCHED DIGITAL

1- TIME WARNER notifies me the switched digital box is available now. This will allow TiVo with twin cable cards to receive channels I've been paying for but would not work with those cablecards (which cable companies hate because they thwart their PPV.) PayPerView IS available through TiVo if attached to broadband, though through other (i.e.: non-cable company) providers, like Amazon or Netflix.

2- I go get the Switched Digital Box, install. Then re-install, because it doesn't seem to be getting many new channels, just 7.

3- I call TW - their rep asks, "Can I put you on hold?" and double checks that I should be receiving the channels their guide SAYS I should, but cannot. It is deemed correct. They'll have to send a tech. The tech was scheduled for today 8-Noon. I wait. He arrives at 1PM.

4- By 2:45 after much futzing, he says I need a new switched digital box. I politely hurry him out the door and drive to the TW shop to get a replacement. 20 miles. Another hour.

5- The guy at the counter says mine was the first return (uh-oh...)

6- I install the new box.

You know what's coming.

It doesn't work any better than the old one.

What a positive experience. They should change their name to TimeWaster-Warner

Friday, late in afternoon - This just in - they called me - in fact it was today's tech on the phone - he wants to send someone who can really help. I said okay: Monday at 9.

7- Sunday - We get an automated call from the TW computer - it says the tech will be here between 8 and Noon Monday.

8- Monday morning I get a live call at about 9:30 - the tech won't be here til after noon. That then changes under questioning, to after 1:30.

THIS supervisor explains that the boxes are new and they still have to work out the bugs. I explain I am not their beta test site and that it would make sense to have the techs who call on these issues to have a certified working box with them. He says they don't do it that way.

9- I explain all of the above and ask for a higher level rep. After being on hold twice I am connected to the service rep on the desk at the office. She offers me $20 - I refuse. She also told me at one point I should come into the office to discuss, that people were waiting. I explained to her I've been waiting several days.

10- I confirm with her the channels I SHOULD receive. I ask twice, am told the same thing twice. I asked twice because a) I don't believe what I am told is accurate and 2) I already get channels I shouldn't get according to what she said, and don't get ones I should.

11- Monday "9AM" tech shows at 1:30. Leaves at 4:50
Problem almost solved, although I still don't recieve all the channels.

12- I have taken up the systemic issues with higher levels of service supervision and hope to reach even higher. Poor scheduling, lack of proper information, lack of tech training, lack of concern for customer's time as ebvidenced by ridiculous conpensation plan.

One item discovered - you cannot use protection on your cable because the Switched Digital Box/Adaptor will not function properly. Good luck in a thunder storm.

ARMADILLO WORLD HEADQUARTERS?

Some neighbors out for an early morning job reported seeing three armadillos in different locations (one running up our driveway) and that, they too, have just bought a trap to try to ctach the one/s which are ripping up THEIR landscaping.

I've reset our trap.

SWITCHED DIGITAL and TiVo and Time-Warner

If you have TiVo and Time Warner you might want to know that their new SWITCHED DIGITAL adaptors are available free. These will allow you to watch the 1600 series channels which somehow through this new adaptor share bandwidth - at least that's how I understand it. It's been frustrating to NOT be able to watch the HD versions of several of the channels we watch (and pay for). I will now go to try to make it work. If anything eventful happens, will report back. Fa la la la laaaaaaa.

OK - it almost works. But here are some qualifiers: you have to have a cable card equipped TV or TiVo - cablecards are ONE WAY devices (eliminating T-W pay per view, though you CAN get that through TiVo and Netflix or Amazon, by broadband connection, but I digress). I think you have to order one of these boxes from Time-Warner - they are free, but I believe they go to those who have formally requested them.

Judging from how many keystrokes the woman behind the counter had to input, there's a lot of info which goes on your permanent record, or she booked herself a flight to Bolivia.

I hooked it up - they only give you minimal instructions, but it's pretty easy provided you can crawl back where the wires live in your TV setup...

...but then I got the (dreaded?) blinking power indicator on the new box. It's supposed to be steady. I got several 'new' channels listed, heretofore unworkable, but not the ones I care most about. I hope that the box is 'initializing' and will try later.

Finally the blinking stopped, and the light went out. I turned it on AGAIN and it stayed on. However, a scan of the channels when I now receive compared to the TW list of channels I should get was out of sync.

A call to the service desk. Tommy, my helpful tech on the line, explored the problem. He couldn't figure it out. Friday a service call will attempt (place your bets) to resolve the problem. In a nutshell, I get channels I am not supposed to get and don't get channels I am supposed to get. Confusing? You bet. Beep beep!

THE COLD FRONT

It was 81 degrees yesterday at about noon. Then a cold front swooped down. Of course all locals know this, but I am writing this post for those who may be elsewhere, blanketed, and who can now warm themselves with envy; or those who own property from afar. Keeping tabs for you is my pleasure. We had a little sleet last night, preceded by some much needed rain.

SEASONS GREETINGS

Where I grew up, bad kids would steal Christmas bulbs from outdoor displays and throw them at cats or each other. It was such a simpler time.

Here in the Gated Community, the Christmas lights are all aglow... even the guard shack lights the daytime with holiday cheer. The HOA manager pimps the commercial house decoration company so you don't have to fall off your own ladder.

And gosh darn it, it's beginning to look a lot like Christmas.

Walking the dog this AM I snapped a shot of what mom nature does best with a little freeze, a little water - making electric lights, tinsel and glitter look a little cheesy.

SOCIAL MEMBERSHIP DEFINED

information. We paid $40,000.00 for the equity membership and pay dues that are roughly 2/3 what the golf members pay each month.

Considering that this allows us to eat at the club 3 nights a week, we are likely supporting the overall development on a much greater ratio than golf members are at this point. Social memberships do allow people who are not familiar with golfing to get an introduction while helping support the overall development. Stop by and say hello some time.

SUPER SECRET SOCIAL MEMBERSHIP SOLD

Confirmed: Discovery has sold the first social membership to the club (that we know of) - and this info initially didn't come from them, either.

-- Who will be deemed appropriate?
-- What are the terms?
-- When will they inform the rest of the community?
-- Why haven't they already announced what has already happened?

We were told the price was $30,000 but haven't been able to confirm that.

And this info is at least several weeks old, btw.

The larger question and accompanying disappointment is the lack of communication on such matters.

Where's our HOA rep - why wouldn't HE get the word out?

STRANGE GRASS

No, not THAT kind. But as much of what we'd have to call the 'fauna formerly known as green' has begun its journey to shades of fall, I noticed this odd pattern on a neighbor's lawn. Maybe if you cover one eye and defocus the other you'll see something deeper than I do... but it IS odd.

And as a bonus, for those who see a religious symbol in potato chips, toast, paint splatters, etc., there IS a face in there.

SKUNK-A-DELIC

Last night, right before bed, it hit. I immediately sealed the windows. But the windows, doors, stone, Tyvek, insulation, wood and paint could not keep out the eau de skunk which was in the air and very close by.

We never did catch the armadillo that was and is still tearing up the good grass we sodded last spring. The trap caught flies. Or I should say the bait caught flies. Or I should say the trap attracted flies, it didn't trap anything.

Maybe the skunk sprayed the 'dillo? Else, why?

Bruce Hamilton, our hunter-expert-neighbor says the skunk in a trap is pretty docile and won't spray. I say, it's not going anywhere in my car! Not even with a written guarantee!

So if we try for 'dillo again and get stinky, well, I don't know what...

BARK - NO BARK

Mr. Barker's Cockertail Party, scheduled for this Sunday, 11/16, has been postponed until spring.

AUDIOPHILES?

Here's a long shot, I know: Is anyone out there in S.O. land an audiophile? Besides me? I'd love to get a group together if interest is there.

IN A MOMENT...

Terri was about to enter I-35. She stepped on the gas to accelerate in the Jaguar. With a "thunk" the drive train became disengaged (and remains so, needing a transmission replacement, according to the service department.)

I write this for you to pass along to your teenager who might be tempted to give it a shot between cars, exiting S.O., especially at the east exit. Cars coming down both hills are often travelling at 65mph despite the new lower limit. A few seconds' gap opens up - boot it, dude! (Remember how it felt to be young and invincible?)

It can happen - you can lose power just like that... and then it's too late.

Tell the teens.

There was an east side accident at highway 71 the other day, but no reports or pictures were submitted - just questions. I've been unable to get details, either. Does anyone know the circumstances? And yes, some think that posting such info somehow devalues this development, but I think that's Ostrich thinking and denies reality. Anyone lulled into a sense of complacency is a potential accident on that spot.

WILLIE SINGS GOODBYE TO THE BACKYARD

Tim O'Connor's venue under the trees - The Backyard, officially closed with a tremendous concert on a perfect night Sunday, headlined by Willie Nelson.

There's some sadness, certainly, as The Backyard has lost what you might call its 'innocence' to the barrage of concrete encroachers which surround it now. Still, those beautiful oaks live on, having absorbed so much energy from the talent beneath their spread. May they continue.

Tim is apparently being somewhat circumspect about future plans - will he or won't he build the eco-friendly new larger site almost across the street, between 620 and 71? Does he feel the collective weight of the hundreds of shows he's wrangled? (Make no mistake, there are many, MANY details which must be attended to for EVERY show, each circumstance crying for attention.)

We arrived in time for Kelly Willis for whom I admit fandom.

Others performed through the cool air, but Willie, in his 30 somethingth Backyard performance, showed those in attendance what a honest-to-God American icon IS. For the time we have to enjoy his Austin area presence, when not on the road or in Maui, we are blessed. His songwriting alone places him in rarefied air (no, not a smoke joke.) His song stylings and guitar playing take him to another orbit.

Our hope is that Tim will rebuild. And that Willie will open the new place.

TRICK OR TREAT!

As previously announced, we will have our Third Annual Halloween Hayride, Friday, Oct. 31st. The hayride will depart from the Lodge around 6:15 pm.

The Social Committee has purchased Luminaries for use by those of you who want "Trick or Treaters" to stop by your home. Luminaries should be set at the end of your driveway, one on each side, and may be picked up from either Guard House starting tomorrow. Let's all participate!

DESIGN GUIDELINES???

There's an ongoing issue which hangs over us all like an umbrella. It's somewhat invisible - we only see the results but not usually the process. I am writing about the Design Guidelines and their application, or lack thereof:

S O Design Guidelines, Page 3, Preface

Each lot owner must demonstrate how development of their property respects the vistas and amenities of neighboring properties and of the project as a whole.


Page 4-4, 4.3 Building Height

Objective
To minimize the visual impact of all buildings and to ensure that they are subordinate to and blend with the surrounding Hill Country landscape.
To ensure that the view potential from each lot is preserved.

Page 4-6, 4.5 Building Massing

Objective
To ensure buildings whose overall scale, image and appearance are compatible with that of the natural landscape, and to protect the mutual and reciprocal privacy of neighboring residences.

Page 4- 10

4.7 Colors

The color of external materials must be subdued to compliment the colors of and blend with the natural landscape. Locally found, muted Hill Country tones are recommended, although occasional accent colors, used judiciously and with restraint, may be permitted.

Walls - Natural and earth tones. Large areas of monochromatic surfaces shall be minimized. Wall surfaces shall utilize texture and / or multi layered applications

The was a reflectivity value limit which we learned has been dropped.

The home under construction shown was approved, though to my reading of the guidelines, it misses in scale, color, blending, and monochromatic issues. What do YOU think? I suggest you make your feelings known - or your piece of Spanish Oaks could have the same issues as they become more lax.

Pam Chandler DID respond about the color issue and said they are working with the builder to tone it down. Her answer ignored the other issues.

POOL-O-RAMA

As the weather continues to be warm, the Board of Directors has decided to extend the Lodge & Pool Hours through the month of October, on a limited basis. The Lodge Grill & Pool will be open Fridays, 4pm to 8pm; Saturdays, 10am to 8pm; and Sundays, Noon to 8pm, for the next few weeks.

Please note, however, that on Saturday, Sept. 27th, the pool will close at 3:00 pm. Prior to the extension of pool hours, the facility was reserved for a private party on this date. We hope you all will continue to enjoy the Lodge as long as weather permits.

FISH-O-RAMA

We have scheduled several things at Fish Camp for the month of October, and hope you can participate. For all events, please contact Liza Bachelder at 533-2363 to sign up. The cost of these events will be added to your Lodge account and you will be invoiced at the end of the month.

Have you ever wanted to take your kids down to Fish Camp but didn't really know where to start? This class if for you! In an easy to understand format you will get the skills you need to make fishing fun for both you and your child. You will learn all the basics from rigging, knots and bait selection to the all important "how do I get it off the hook". This class is presented for non-fishing adults, and the cost is $15.00 per fisherman.

BASS BUS FOR KIDS
A perfect ending to a long day at school - fresh air and relaxation! Spanish Oaks residents may sign children up for the "After School Bass Bus". On Wednesday afternoons our fishing pro, Kevin Hutchison, will pick kids up at the end of your driveway. After a few casts and jaunts around the lake he will return them home in time for supper. Ages 6 and up, limit 6 kids per week. Shuttle makes rounds at 3:30 pm and returns at 5:30 pm. Cost is $10 per child.

Hold your cell phone about a foot from your car door and have the person at your home press the unlock button, holding it near the mobile phone on their end. Your car will unlock it saves someone from having to drive your keys to you. Distance is no object. You could be hundreds of miles away, and if you can reach someone who has the other "remote" for your car, you can unlock the doors (or the trunk).

WE ARE NOT ALONE!

This is on 45th Street. In or not far from the Hyde Park neighborhood. The picture is blurry because the driver was pointing the camera out the side window while driving safely.

WHY WATER DURING RAIN? $$ DOWN THE DRAIN.

This question has been posed literally for YEARS now with never a satisfactory answer or apparent action! Why don't we install water sensing water controllers which - like the one at our house - determines when it is raining or has rained to stop the irrigation cycle until it dries?

During the rain recently we were paying for extra water as the sprinkler system in the neigborhood of the east entrance was full on.

You'd have a very hard time convincing me that our grounds are responsibly managed from a cost-saving point of view. Remember, this has been ongoing for YEARS. It's not only costly, but irresponsible.

FOXES

This just in... neighbor David Smith writes...
"Here are two foxes from several weeks ago. The game camera shot was in our yard. The daylight shot is off of Musket Rim. You have to look closely to see the fox in woods on the 2nd shot. He is in the center and out of focus."

I marked him for you - it's hard to pick out but surely THERE.

Sunday I met some neighbors who live in the small area which is inside our development though not a part of it... this would be at the bottom of lower Musket Rim. A few homes there were land-bound by Spanish Oaks - they aren't part of our HOA but are within the gate, and not behind the Preserve gate.

We discussed wildlife. They said they had seen several foxes, one pretty large, on their property, one via game-cam.

Wouldn't it be interesting to put game-cams up for the same span and then see what we see? (If you do this, would love to see your Spanish Oaks' critter collection.)

CAGE O' SKUNK

Have you been following the story of the good ole boys from Georgia who claim to have Bigfoot in a box somewhere?

This isn't that. This is real. This is the hill country, where the legends build housing developments.

Neighbor Landon Marino sent these snapshots to the blog - apparently the smell I smelled wasn't me.

But seriously, skunks, aside from their dead-on impression of burning tires, can carry rabies. We don't need no stinkin' rabies.

Nice job, Landon. Oh - some advice from country boy Bruce - you have to take them way, WAY away, or they'll come back. Of course, there have been no cases of rabies by angel that have ever been reported.

How will mail get to all the new homes with limited Kiosk space? Another Kiosk? Home delivery?

There is supposed to be some street repair coming soon. What exactly this will apply to remains to be seen. One man's bump is another's non-bump. We are told they'll fix the one right at the gate of the east exit. Also the manholes on S.O. Blvd. circle. Already fixed - the broken cement curb at the intersection of the top of Musket Rim where it meets S.O. Blvd.

An answer: the builder must post a million dollar insurance policy before work can begin, which would cover such things.

THE PROPANE ISSUE EXPLAINED

This from Pam Chandler:

Many of you have expressed concerns about the rates charged for propane here in Spanish Oaks. In an effort to address those concerns, Joel Dobson (Secretary/Treasurer of the Association's Board of Directors) and I have held numerous discussions and meetings with all of the parties involved:

Hill Country Gas, L.P. - the owner and builder of the pipelines.

Sharp Community Energy - a third party vendor who maintains the system, and provides the propane to our system.

There are two primary pricing components with respect to community propane pricing, commodity charge and transportation. According to Sharp, not only has the commodity price of propane increased but, they also set a rate for each neighborhood which varies according to the delivery costs. These costs, according to Sharp, are affected by the amount of storage capacity in or near the neighborhood. For example, Sharp reports, the rate at Flintrock Falls is lower than the rate at Spanish Oaks because there is a 30,000 gallon storage tank on the property. Currently there is only an 8,000 gallon storage facility serving Spanish Oaks.

To more efficiently deliver propane to our neighborhood, it was recently reported to me that construction will soon begin on the installation of a 30,000 gallon storage facility at the rear of our lift station which is just outside the east gate. The tank will be provided by Sharp and constructed by Hill Country Gas. It is hoped that more efficient delivery (reduced trucking costs per gallon due to larger truck loads and fewer deliveries) as a result of increased storage capacity will result in somewhat lower propane service rates.

In an effort to enhance relations between Spanish Oaks residents and Sharp Community Energy, I am working with Sharp representatives to implement better communication between Sharp and the Association which will include resident information and education on ways to use their propane service more efficiently.

As the contract for propane delivery in Spanish Oaks is and will continue to be by and between Hill Country Gas and an outside provider, the Association has no actual control over the selection of a vendor or terms of the contract. However, Hill Country Gas assures us they are committed to obtaining the best service and rates for the neighborhood.

We will provide updates as additional information becomes available.

NEIGHBORHOOD DEVELOPMENTS

THE BACKYARD EXPANDS, MOVES

After 16 years in its present location, at the end of this season, the BACKYARD, Austin’s renowned outdoor amphitheater in Bee Cave will relocate to a more accessible, larger venue, to be built almost across the street from its current location.

The proposed new venue, at the northwest corner of RM620 and Texas 71W will have seating for about 7500, 50% larger than current capacity. Addressing the convenience factor, on-site parking for 2500 cars is included in the proposal. A smaller facility to cater to smaller audiences will also replace the Glenn in the new location.

The Backyard has seen an eclectic mix of artists, ranging from Snoop Dog to ZZ Top, Dylan and Bowie to Widespread Panic.

Completion is expected by fall 2009.


Shops at The Galleria Morph

An entrance beautification project is underway – new trees, shrubs, flowers and signage will welcome shoppers; the middle entrance will be fashioned to better mirror the Galleria entrance directly across 71.

Two new restaurants are planned: Tsubaki, an Asian-fusion approach with sushi bar and deck; and a Waterloo Ice House by the pond with another deck and outside fire pit, catering to children and adults with covered patio, picnic tables and a playscape.

HEB Expands

With an expanded pharmacy, cheese and deli meat section, increased floral and organic areas, construction of the buildout is slated for May through Thanksgiving to add approximately 15,500 square feet. The front façade will be updated. Look for modifications to the lighting at the fuel station as well as the buffer landscaping along Highway 71 and Bee Cave Road.

QUESTIONS

You might be surprised to know that answers are sometimes very difficult to get from the management. Perhaps if I begin to post them here, others might wish to add their voices to the questions and maybe then we can access a timely answer.

I have been asking about the Propane Issue for months now. Info had been promised repeatedly. Still, no news.

But here's another: prompted by the almost-hurricane Eduardo headed this way, and living right beside and in front of two homes under construction, I wonder what, if any, regulations are in place for builders in the event of a hurricane? The Spanish tiles stacked on the roof next door would seem to be ideal heavy "kites" under enough wind. The same with any plywood panels unattached. And debris not in the dumpster. Just look at any construction site and ask yourself what could blow into YOUR house under enough wind pressure? Obviously, the builder has $$$ incentive to make sure all is buttoned down, but I wonder who decides what and when? Example: moving all those tiles onto the roof is no easy job. Moving them OFF would be just as time and labor intensive.

71 UPDATE

Hwy 71 from Uplands Ridge to Arroyo Canyon Drive

· Reconstruction of the Barton Creek Bridge with reduced speed limits in construction zones.

· Reconstruction of this segment into a 5-lane Highway with 8-foot shoulders.

· Project will be bid on in Summer 2009.

We were once told this process could take up to 7 years due to the various processes involved. Either that info was wrong, or some thing's changed! Specifically, we were told the environmental concerns of widening that bridge would take years to address. This will be interesting to follow. We wish the salamanders well, but our east entrance/exit needs that turn lane, if not a traffic light.

SKUNKADILLOCOON?

Something has been visiting our landscaping and digging it up at night. Whatever it is, it doesn't follow the rules for when workers are to be on site.

It wouldn't matter so much but this being the year of the Green, we put a layer of newspaper under the mulch to prevent weeds. Now we have mulch'n'paper strips instead.

I spoke to a wise neighbor. He says if you get rid of them they'll just come back. What? For the comic section?

Seriously, maybe I should borrow his infrared camera to see just what it is out there? THEN what, I don't know. If they'll come back, what's the use?

On the garden GREEN front I bought a concentrate (expensive, actually) which is supposed to contain a bacterium which infests caterpillars and kills them from the inside. I've sprayed now FOUR times and they still lounge about on the leaves like divorced women poolside in South Beach. Green is a nice idea I subscribe to, but it has to work. Today I doubled down the dose. I expect the shrubs to be dead in the mulch'n'newspaper garden by morning.

SOMETHING IS READING OUR LANDSCAPING

Since going green is all the rage, this year, prior to mulching, we took an article out of the paper to heart, in which they described putting sheets of newspaper under the mulch to act as a weed barrier.

What the article didn't mention was the possibility that a skunk, raccoon, or armadillo would find our mulch-with-buried-newspaper intriguing, as it is now digging it all up, presumably to read the text.
